Dear Parents/Guardians:

As you may have heard, the United States Department of Education (USDE) declined the petition to grant a blanket waiver for state assessments and NYS is now awaiting the two waiver requests related to state assessment and accountability requirements anticipated from the the USDE in April. As a result, the New York State Board of Regents acted on a series of emergency regulations to allow for exemptions to diploma requirements associated with the June 2021 and August 2021 Regents Examination administrations. The NYS Board of Regents voted to cancel all but four of the Regents Examinations scheduled to be administered in June 2021 and all of the Regents Examinations scheduled to be administered in August 2021. These examinations shall be administered only in instances where schools and districts can ensure the health and safety of students and teachers. We have also determined that students receiving remote instruction should not be made to come to school for the sole purpose of taking a Regents Examination. Below are frequently asked questions that required further clarification.

Q: Which are the Regents exams that are being administered?: A: English Language Arts, Living Environment, Algebra I, and Earth Science (written test only).
Q: Are students who are participating in in-person learning expected to take Regents exams?: A: Yes
Q: Can a parent opt out of testing if their child is participating in in-person learning?: A: Yes, students can use the exemption.
Q: If a student who takes one of the four Regents Examinations being administered in June 2021 and fails, may they still qualify for an exemption to the diploma requirement associated with the examination?: A: Yes, as long as they pass the required course associated with the exam.
Q: Do in-person students have to take the Regents in order to be eligible to access the exemption?: A: No, the guidance does not require a student to take the Regents in order to be eligible for the exemption.
Q: If a student takes a Regents and passes the exam with a 65+, but is not happy with their grade, can they request an exemption appear on their transcript rather than the grade that they are not satisfied with?: A: Yes. They do not have to include their score on the transcript.
